Terms & Conditions

Definitions

  • “We”, “us”, “our” or “Alp Trails” shall mean Bruno Yates, registered in France as a Professionel Liberal.

  • “You”, “your”, the “client” and the “visitor” shall mean the person visiting the website and/or booking a tour with us in accordance with these terms and conditions, together with any member of such person’s party or group.

  • The singular shall include the plural, the masculine shall include the feminine and vice versa.

General Terms and Conditions

  1. Health & fitness: Clients should be aware that hiking, trail running and snowshoeing are physically strenuous activities that require a sufficient level of fitness to be able to exercise in the mountains for up to 8 hours (with breaks) and cover considerable distances with height gain. The tours involve walking/running on a variety of terrain, including undulating, rough and sometimes steep paths, loose or slippery ground, and in the case of winter tours, on snow and ice. Each client should be confident that he/she is sufficiently fit for the type of day that they have booked.

  2. Medical information : We ask that you complete and return the Booking Form, detailing any medical conditions that are pertinent and may affect your ability, or anybody else listed on the booking, to participate in an active day in the mountains. If you, or anybody else listed on the booking, suffer from a medical condition that may affect your ability to participate, you must provide a medical certificate from your doctor stating that he/she believes that it is safe for you to do so.

  3. Previous experience: When filling in the Booking Form, we ask that you give a brief description of level of fitness and previous experience for both you and anybody else listed on the booking. In doing so, Alp Trails will be in a better position to subsequently tailor a tour to meet individual/group needs.

  4. Clothing and equipment: Clients should be in possession of adequate clothing and equipment to cater for a range of weather conditions and sudden changes in weather conditions which is a common occurrence in the mountains. Alp Trails lists the recommended clothing and equipment to be used, on the website and by email, after booking.

  5. Responsibility: We are more than happy to give guidance regarding suitable levels of fitness, any medical issues that you think might pose a problem and/or the suitability of your clothing or equipment. If you have any doubts it is your responsibility to inform Alp Trails (via the Booking Form) or seek clarification (by email). In doing so, Alp Trails will also be in a better position to subsequently tailor a tour to meet individual/group needs.

  6. Denial of participation: Alp Trails reserves the right to refuse to commence a tour or to alter a tour itinerary or schedule if it becomes apparent that information has not been shared that might subsequently put a client/clients/the guide and/or the group at risk. Similarly, Alp Trails reserves the right to refuse to commence a tour or to curtail a tour if a client refuses to follow the instructions of the Alp Trails guide, behaves in an inappropriate or dangerous manner or has inappropriate/inadequate clothing and equipment. In these circumstances, it will be regarded as a cancellation by you and no refund will be possible.

  7. Acknowledgement and acceptance of risk: Hiking, trail running and snowshoeing, by their nature, involve an element of risk which cannot be entirely eliminated. Every care is taken to ensure the safety and well-being of our clients during our tours. However, participation in adventurous activities does require the acceptance of risk and by booking a tour with Alp Trails, you acknowledge the risks involved and accept the responsibility each individual has for the consequences of their own actions.

  8. Limitation and exclusion of liability: Alp Trails shall not be held liable for any loss, damage, additional expense, disappointment, frustratic injury, death or other harm suffered by any client, as a result of any delay, change of route, accident or otherwise in the course of the tour caused other than by the negligence of Alp Trails.

  9. Third party operators: We do not own or operate any site which we may visit on our tours or any other entity/establishment which may provide goods or services. The owners or operators of such sites and entities/establishments providing goods or services are independent parties/suppliers. As a result, we are not liable for any negligent or willful act of any such person or entity or of any third person.

  10. Promotional photography: We take photographs during the tours to use for promotional purposes. Some of these photographs may include images of you and anybody else listed on your booking. By booking a tour with us you agree to allow your images to be used in such photographs. If you’d prefer that your images not be used by Alp Trails, please let us know at the start of a tour.

  11. Insurance: It is essential and therefore a condition of booking that you have an insurance policy that includes comprehensive cover for the type of adventurous activity that you’ve booked with Alp Trails (hiking/trail running/snowshoeing). This insurance policy should cover personal injury, medical treatment and rescue and repatriation costs (including helicopter rescue and air ambulance) and needs to be valid for activities up to 3000m altitude. We recommend that your travel insurance also covers personal property and trip cancellation.

If you wish to cancel your tour, you will receive a full refund minus a €20 admin fee up to 4 weeks (28 days) before the tour date. If you wish to cancel between 4 weeks (28 days) and 1 week of (7 days) of the tour date, we reserve the right to retain 50% of the total cost of the tour. If you wish to cancel less than 1 week (7 days) before the tour date you will be liable for the entire cost of the tour.

There may be a delay of several days in the processing of refunds.

A late arrival or no-show for a tour shall not constitute a reason for a refund.

Whilst every attempt is made to ensure that tours actually run, Alp Trails reserves the right to change the location or content of a tour, to suit weather conditions or other conditions prevailing in the mountains at the time (e.g. a high avalanche risk on a winter tour). We also reserve the right to alter or cancel tours due to illness or circumstances beyond our control.

In the event of a necessity for Alp Trails to alter or cancel a tour, we will endeavour to inform the clients as soon as possible with the option of a full refund for a cancellation or the option to re-schedule to a later date at no extra cost to the clients.

Alp Trails reserves the right to change these terms at any time without notice, including the tours, prices, fees and charges, provided that no change shall increase the price already paid for a booked tour.
